Regarding ta`zir (punishment), can suitable punishments be taken into consideration in the law to prevent inconsistency and difference of procedure to a great extent?

Since both sides of the proposition are problematic and those in charge of judicial affairs predominantly lack the qualifications of religious standards, «1» you are advised to consult the respectable Guardian Council on the question to work out a solution with the least deficiency. May peace be upon you.
