Questioner: Yousuf Sani`i (Prosecutor General)
[His Holiness Hadrat Ayatullah al-`Uzma Imam Khomeini- may his sublime presence endure,
You are kindly notified that a number of cases are under investigation in Islamic Revolution Courts situated in Shahid Quddousi Intersection. These cases are either liable to Your Eminence's amnesty or subject to punishment according to rules. The penal code applies to the latter cases' property and the religious judges confirm their punishment. They are in debt as far as the khums of their profitable earnings is concerned. Some of them owe two cases of khums due to mixture of lawful and illegal gains. Does His Eminence permit the said courts to collect the khums with the agreement of the prosecutor general of the court concerned and remit the sum to the account of the prosecutor general's office in charge of Islamic Revolution Public Prosecutor's Office to be used in cases for which public budget regulations do not apply. Obviously, if a sum comes to be in excess, it will be remitted to the account of the government.
