His Holiness Great Leader of the Revolution, Ayatullah al-`Uzma Imam Khomeini, May your sublime presence endure,
After greeting, regarding the charity organization of the late Hamedaniyan whom Your Excellency have entrusted me to investigate and supervise, the process is that the late Husayn Hamedaniyan has drawn up a constitution in 24/3/1344 AHS willingly, setting Isfahan as the place the properties to be consumed and the authority to use to be vested with him during his life. Then in 30/4/1353 AHS he was arrested in Isfahan on an excuse and since his property has been exceeding by large and had no child, the system «1» coveted his property. Finally, in 8/2/1354 AHS when in Korshid Hospital in Isfahan, while still under arrest, calls the registration official of Isfahan and draws up another constitution and gets it registered. Since the new constitution contained goals meeting his purposes, the system is not contented. Later in 30/11/1355 AHS in Karaj with agreement of Monarchical Organization representatives, he enacts a third constitution, officially affiliating the institute to the said organization. Again the system is not contended as he incorporates articles fulfilling his own goals. The constitution will not be registered. Eventually, with the pressures exerted by the system, without satisfaction of the founder and by reference to article 11 of the constitution registered in 1354 AHS, the board of trustees are changed and his properties are entirely transferred to the organization. «2» He pursues the case but his attempts fail. After studying the different constitutions and collecting information about the goals of the institute and after consultation and inquiry of the registration official of that time whom I accidentally know and is trusted by me and is currently retired and after talking to sister of Hamedaniyan and his brother's representative who is a deserter and legally heir to him, also requesting you in writing, transfer the affairs of the institute to me. I understand that observance of the law of official registration and goals of the founder and satisfaction of the heir (to whom transfer of the property in the constitutions is subject to misgiving of reluctance) and preventing the undue changes and finally observance of caution altogether necessitates that the officially registered constitution in 8/2/1354 AHS that the founder said met his satisfaction if acted upon (and according to existing documents in his file even after Karaj constitution it has been stressed to be acted) should be acted.
In this constitution place of consumption is Isfahan and the board of trustees consists of five officials and two persons as follows: 1) Chief Justice, 2) Isfahan Governor, 3) Iran Bank Melli Manager, 4) Isfahan University Chancellor, 5) Head of Justice Department in Isfahan. The two persons are currently not available. The three officials have been cited in the Karaj constitution and since the two persons are not available according to article 10 of the constitution, two officials can be selected of the five officials.
The only thing necessary to be added is that in article 11 which cites the authorities of the board of trustees, we read:" They are not entitled to dissolve the institute and change the manner of consumption."
It should be added" They are not also entitled to change the five officials of the board of trustees" to observe the necessary preventive measures. Meantime, since many of the properties of the institute have been taken over, the influential board of trustees should restore the lost possessions so that the satisfaction of the institute and heir and God would be fulfilled. This is my personal view. Authorization for execution is pending Your Eminence's order. May God's peace be upon you!

By appreciating the efforts of the late Hujjat al-Islam Mr. Khadimi «3»- May God's peace be upon him- and expressing gratitude to all the gentlemen who directed Hamedaniyan Institute with my approval and exerted great efforts in this way and preserved the properties and served Islam in this good act, now that after long studies the content of the will and testament and the endowed property has been specified, it is necessary to be acted the way written in the paper. May God's peace by upon you!
